1. Acceptance of these terms
By accessing, browsing or using PanamAdventure, you accept these Terms and Conditions. If you do not agree with any part of these terms, you should not use the platform.
PanamAdventure is an informational digital platform focused on tourism, adventure, nature, culture and experiences in Panama. Its purpose is to organize and present tourism information in a clear, useful and responsible way.
2. Platform identity
For the purposes of these terms, “PanamAdventure”, “the platform”, “we”, “us” or “our” refers to the independent digital platform managed by an individual under the public name PanamAdventure. The platform is not a separate company, legal person or taxpayer. Whenever these terms attribute an action, obligation or right to PanamAdventure, they refer to the individual who manages the platform. The contact channel is [email protected].
3. Permitted use
You may use PanamAdventure to consult tourism information, explore destinations, read recommendations, learn general references about places and plan visits under your own judgment and responsibility.
The platform must be used lawfully, respectfully and in accordance with these terms. You may not use PanamAdventure for fraudulent, misleading, illegal or abusive activities, or in any way that may affect the operation, reputation, security or availability of the site.
4. Intellectual property and protected content
Unless expressly stated otherwise, all texts, destination profiles, descriptions, photographs, videos, logos, illustrations, icons, visual design, editorial structure, databases, code, selection of information, organization of content and other materials published on PanamAdventure are owned by PanamAdventure or used under authorization, license, permitted reference or legitimate source.
Copying, reproducing, distributing, modifying, adapting, extracting, republishing, selling, sublicensing, scraping, mass downloading or commercially exploiting PanamAdventure content without prior written authorization is prohibited.
The fact that content is publicly available on the internet does not mean that it is in the public domain or that it may be freely used for other websites, social media, apps, tourism guides, catalogs, databases, promotional materials or artificial intelligence systems.
5. Automated extraction prohibited
You may not use bots, crawlers, scrapers, scripts, browser extensions, automations or any other mechanism to copy, collect, index, download or reuse PanamAdventure content in bulk without express authorization.
You may also not use platform content to train, feed, enrich or validate artificial intelligence models, recommendation systems, commercial databases or third-party digital products without written permission from PanamAdventure.
6. PanamAdventure brand and identity
The PanamAdventure name, logos, symbols, mascots, phrases, visual identity, brand design and related graphic elements may not be used, copied, imitated or adapted without prior written authorization.
No person or entity may present products, services, profiles, campaigns, publications or websites in a way that suggests association, sponsorship, approval or official representation of PanamAdventure without express authorization.
7. Tourism information and verification
PanamAdventure aims to present clear, useful and updated information; however, tourism information may change without notice. Schedules, fees, access conditions, restrictions, weather, permits, service availability, trail conditions, transportation, entry rules and local regulations may vary.
Before visiting any place, users should verify information directly with official sources, authorized operators, local authorities, site administrators or the corresponding service providers.
8. User responsibility when visiting destinations
Any tourism, adventure, hiking, beach, mountain, boating, wildlife observation, natural area visit or travel activity in Panama involves risks. Users are responsible for evaluating their physical condition, experience, equipment, weather, safety, transportation, permits and accompaniment before undertaking any activity.
PanamAdventure is not responsible for accidents, injuries, losses, damages, cancellations, route changes, third-party failures, natural conditions, actions by authorities, weather events or decisions made by users based on the information published on the platform.
9. Third-party links and services
The platform may include links, references, maps, social media, external sources, tourism operators, businesses, transportation providers, accommodations, restaurants, public institutions or other third parties.
PanamAdventure does not control or guarantee third-party content, availability, accuracy, policies, prices, services, security or practices. Use of external sites, services or products is the user's responsibility and is subject to each third party's own terms.
10. Content submitted by users or contributors
If a user, contributor, photographer, guide, operator, community or third party sends texts, photographs, videos, comments, corrections, suggestions, data or any other material to PanamAdventure, they declare that they have the rights or authorizations necessary to share such content.
Submission authorizes only private receipt and evaluation for the time reasonably needed. It does not authorize publication, translation, promotion or exploitation. Every public use requires a specific authorization or license identifying the item, scope, channels, territory and term.
Applications and contributions to the Local Talent program are also governed by the Participation Agreement and the Individual Record for each item. Those documents prevail over this section, and no general clause licenses portfolios or an undefined set of future works.
11. Reporting errors, rights issues or improper content
If you believe that any content published on PanamAdventure contains incorrect information, infringes copyright, uses an image without authorization, affects third-party rights or should be reviewed, you may contact us to request an evaluation.
PanamAdventure may correct, update, hide or remove content whenever it considers necessary, especially when there are reasonable doubts about its accuracy, authorization, relevance or legality.
12. Privacy and personal data
The processing of personal data related to forms, contact requests, subscriptions, analytics, user accounts or other services will be governed by PanamAdventure's Privacy Policy, when applicable.
Users must provide truthful information and must not use third-party data without authorization. PanamAdventure may retain communications, requests or technical records when necessary for security, support, legal compliance or protection of its rights.
13. Platform availability
PanamAdventure may modify, suspend, limit, update or remove sections, features, content or services at any time, without any obligation to maintain permanent availability.
We do not guarantee that the platform will be free from errors, interruptions, technical failures, attacks, loss of information or incompatibilities with all devices, browsers or systems.
14. Limitation of liability
PanamAdventure is provided as an informational and editorial platform. To the fullest extent permitted by applicable law, we are not liable for indirect, consequential or purely speculative loss caused by use of or inability to use the platform. This limitation does not exclude fraud, wilful misconduct, gross negligence, our own confidentiality or personal-data breaches, deliberate intellectual-property infringement, recognized payment duties, or rights and liabilities that mandatory law does not permit the parties to limit.
15. Changes to these terms
PanamAdventure may update these Terms and Conditions when necessary. The current version will be the one published on this page, identified by its last updated date. Material changes requiring consent or modifying a recorded relationship will be presented for renewed acceptance. No update retroactively expands a license, reduces non-waivable rights or replaces the specific acceptance required by the Local Talent Agreement.
16. Applicable law and jurisdiction
These Terms and Conditions will be interpreted in accordance with the laws of the Republic of Panama. Any dispute related to the use of PanamAdventure, its content, brand, services or terms will be submitted to the competent authorities of the Republic of Panama, unless an applicable rule provides otherwise.
